Guardianship or Power of Attorney
when Leaving our nest?

What legal protection is best for an adult child with special needs?

Our developmentally delayed adult daughter is 24 with a mental age of approximately 6.

We are getting ready for her to begin exploring whether she wants to live away from home or stay here with her family.

We have an RDSP set up for her and are working on getting the only outstanding 'back' grant for the RDSP.

I have a will which needs to be updated.
  • Are there other things we should be specifically setting up with regard to her finances?

  • Do we need to set up a legal guardianship or power of attorney to ensure she is protected?

  • I have been asked by the bank and in a couple of other situations if I have Power of Attorney and I have always just said yes and never been asked to provide documentation.

It horrifies me to think that I would not be allowed to make decisions for the my child just because she is now legally considered an adult.

If I find good products that I think offer value and would be of interest to my site visitors, I occasionally will provide my visitors with an affiliate link.
Some (but not all) of the links on this site are to my affiliate referrals. Any recommendation or referral I offer my visitors is independent of the existence of a possible affiliate fee, and my primary goal is to provide my visitors with useful information.
